Terms of Service (Terms and Conditions) – MatheArena FlexCo

1. Scope and General Provisions

1.1 These Terms of Service (hereinafter “Terms”) apply to all services provided by MatheArena FlexCo, headquartered in 4921 Hohenzell (hereinafter “MatheArena,” “we,” or “us”), via the website www.mathearena.com and mobile applications (apps).

1.2 By registering or using our services, the user (hereinafter “you” or “user”) agrees to be bound by these Terms.

1.3 Deviating terms and conditions of the user shall not be recognized unless MatheArena expressly agrees to their validity in writing.

2. Service Description

2.1 MatheArena provides an interactive learning platform for mathematics. The range of functions extends from free exercises to paid premium content (subscriptions).

2.2 We reserve the right to adapt, expand, or temporarily restrict the service or parts thereof in the context of technical development and to improve the learning experience.

3. Registration and Contract Formation

3.1 The use of certain functions requires the creation of a user account. You are obligated to provide truthful information.

3.2 The contract for use of the service is concluded upon completion of the registration process (confirmation of email address).

3.3 For paid subscriptions via in-app purchases, the contract is concluded by confirming the purchase with the respective app store operator (Apple App Store or Google Play Store).

4. Right of Withdrawal for Consumers

4.1 You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of contract conclusion.

4.2 To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g., a letter sent by mail or an email to info@mathearena.com) of your decision.

4.3 Premature expiration of the right of withdrawal: For contracts concerning digital content, the right of withdrawal expires prematurely if we have begun contract performance (provision of content) after you have expressly consented to us beginning contract performance before the expiration of the withdrawal period, and you have confirmed your knowledge that you lose your right of withdrawal through your consent upon commencement of contract performance.

5. Prices, Payment Terms, and Subscriptions

5.1 Prices for premium content are clearly displayed in the app or on the website.

5.2 Subscriptions automatically renew for the selected term unless they are canceled before the end of the current period via the settings in the respective app store or in the user account.

5.3 Payment processing for in-app purchases is handled through Apple’s or Google’s payment systems. Their respective terms and conditions apply supplementarily.

6. Promotional Codes and Special Offers

6.1 MatheArena may issue promotional codes (e.g., discount codes, vouchers) for time-limited special offers.

6.2 Promotional codes are only valid for eligible users and may have the following restrictions:

6.4 MatheArena reserves the right to change, suspend, or terminate promotional codes at any time. In case of abusive use (e.g., sharing with third parties, commercial use), MatheArena may block the code and terminate the affected account without refund.

6.5 For subscriptions with promotional codes: After the discounted period ends, the subscription automatically renews at the regular price unless you cancel beforehand.

6.6 There is no legal entitlement to the issuance or acceptance of promotional codes.

7. Usage Rights and Intellectual Property

7.1 All content (exercises, texts, graphics, software, logos) is protected by copyright and is the property of MatheArena FlexCo or its licensors.

7.2 MatheArena grants you a simple, non-transferable, and non-sublicensable right to use the service for private learning purposes.

7.3 Any commercial use, reproduction, or distribution of content without the express written consent of MatheArena is prohibited. “Scraping” or automated extraction of exercises is strictly prohibited.

8. User Obligations and Acceptable Use

8.1 You are obligated to keep your access credentials (password) confidential and not grant third parties access to your account.

8.2 Misuse of the service is prohibited. This includes the following actions:

a) Technical Abuse:

• Uploading, distributing, or providing viruses, malware, trojans, or other harmful software
• Circumventing security precautions or technical protective measures
• Automated extraction (scraping), crawling, or systematic extraction of content
• Denial-of-service attacks or other actions that impair the functionality of the service
• Reverse engineering, decompiling, or disassembling the software

b) Illegal Content:

• Content that violates applicable law (particularly criminal laws, youth protection laws)
• Copyrighted content without appropriate authorization
• Infringement of trademarks, patents, or other third-party intellectual property rights
• Violation of personal rights, data protection rights, or other third-party rights

c) Harmful and Harassing Content:

• Insulting, defamatory, libelous, or threatening statements
• Hate speech, discriminatory statements, or incitement against persons or groups based on ethnicity, religion, gender, sexual orientation, disability, or other characteristics
• Harassment, stalking, or bullying of other users
• Pornographic, sexually explicit, or otherwise content harmful to minors
• Glorifying or trivializing violence

d) Fraudulent Actions:

• Impersonating false identities or misusing third-party accounts
• Spam, chain letters, or unsolicited mass messages
• Phishing or other forms of social engineering
• Advertising or commercial offers without express consent from MatheArena

8.3 In case of violations of these provisions, MatheArena reserves the right to remove relevant content, temporarily or permanently block your access, and, if applicable, take legal action.

9. Warranty and Liability

9.1 MatheArena endeavors to ensure high availability and accuracy of content but provides no guarantee for constant accessibility or complete error-free provision of exercises.

9.2 MatheArena’s liability for slight negligence (excluding personal injury) is excluded.

9.3 For damages caused by gross negligence or intent, as well as for personal injuries, MatheArena is liable in accordance with statutory provisions.

9.4 MatheArena is not liable for the user’s learning success.

10. Indemnification and Compensation by User

10.1 You agree to indemnify and hold harmless MatheArena as well as its directors, employees, representatives, and vicarious agents from all third-party claims asserted due to a culpable legal violation committed by you. This includes in particular claims for:

• Infringement of copyright, trademark, or other intellectual property rights
• Violation of personal rights or data protection regulations
• Violations of statutory provisions
• Violations of these Terms of Service

10.2 The indemnification obligation also includes reimbursement of costs necessary for legal defense, including reasonable attorney’s fees.

10.3 In the event of claims by third parties, you are obligated to immediately, truthfully, and completely provide MatheArena with all information necessary for examining the claims and mounting a defense.

10.4 The indemnification obligation does not exist insofar as you are not responsible for the legal violation.

11. Special Conditions for Mobile Applications (App Stores)

11.1 You acknowledge that this contract is concluded only between you and MatheArena and not with Apple Inc. or Google LLC.

11.2 Apple and Google are not responsible for maintenance and support of the app.

11.3 Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, have the right to enforce them against you.

12. Termination and Blocking

12.1 You may delete your free user account at any time. Ongoing subscriptions must be canceled via the respective app store.

12.2 MatheArena may temporarily or permanently block access in case of serious violations of these Terms (e.g., abuse, payment default).

13. External Links and Third-Party Content

13.1 Our service may contain links to external websites, services, or third-party content (e.g., social media profiles, partner sites, external learning resources).

13.2 MatheArena has no control over the content, privacy practices, or availability of these external offerings and assumes no responsibility or liability for them.

13.3 By clicking on external links, you leave the scope of these Terms and our Privacy Policy. The terms of the respective third-party provider then apply.

13.4 MatheArena recommends that you review the terms of service and privacy policies of external websites before using them.

13.5 Should you encounter illegal or problematic external content, please notify us at info@mathearena.com so that we can review the relevant links.

15. Final Provisions

15.1 Austrian law applies, excluding conflict of law provisions and the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence.

15.2 The place of performance is the registered office of MatheArena FlexCo.

15.3 The place of jurisdiction for all disputes is, insofar as legally permissible, Ried im Innkreis, Austria.

15.4 Should individual provisions of these Terms be invalid, the validity of the remaining provisions shall remain unaffected.
